California notice at collection and state privacy rights notice: see the state privacy rights notice section below for important information about your rights under applicable state privacy laws. Washington and Nevada residents, see our consumer health data section.
Kaizen Inc (“Kaizen Inc,” “we,” “us” or “our”) provides Kaizen, a social app where you log activities, work toward goals and programs in the things you care about, like running, reading or cooking, and compete with and encourage your friends. This Privacy Policy describes how Kaizen Inc processes personal information that we collect through the Kaizen website at https://kaizen.inc, the Kaizen mobile app, and the other digital or online services that link to this Privacy Policy (collectively, the “Service”). The Service is offered in the United States, and this Privacy Policy is written for users there.
Personal information we collect
Information you provide to us
Personal information you may provide to us through the Service or otherwise includes:
- Contact and account data, such as your name, email address and username. If you sign in with Apple, Apple gives us your name and either your email address or a private relay address that forwards to it.
- Profile data, such as your display name, profile and cover photos, bio, pronouns, website and any place you choose to show, and your settings: your time zone, language, units and currency (which the app reads from your device when you sign up), whether your account is public or private, who may send you friend, challenge and group requests, and whether you appear in search and suggestions.
- Activity and goal data, such as the activities you log or import (their titles, captions, times, measurements, photos, places, workout routes and the friends you tag), the niches you join, your goals, plans, programs, tasks and races, and the progress, streaks, records and badges that follow from them.
- Health and fitness data, such as the workouts you log or import and their distance, duration, pace, elevation, calories and heart rate; daily step counts; and measurements you choose to log, such as body weight, body fat, resting heart rate, heart rate variability, blood pressure, sleep, nutrition, fasting and mood. See consumer health data below.
- Social data, such as the people you follow, friend, block or mute, your reactions, comments, shares, bookmarks and mentions, the clubs, groups, meetups, challenges and events you create, join or RSVP to, the invitations you send and accept, and the reports you make about content or other users.
- Library data, such as the books, recipes, videos, races and other items you save, rate, review or take notes on, and the links you share to the app.
- Communications data based on our exchanges with you, including when you contact us by email.
- Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.
Third-party sources
We may combine personal information we receive from you with personal information falling within one of the categories identified above that we obtain from other sources, such as:
- Apple Health. If you connect Apple Health on your iPhone, the app reads the workouts you allow (runs, rides, walks, hikes and swims), their distance, duration, active energy and, if you allow it, their routes, along with your daily step counts and the name of the app and device that recorded each workout, and sends them to us. It reads in the background so new workouts arrive on their own. The first time, it reads the last 30 days.
- Strava. If you connect Strava, Strava sends us, with read-only access, your Strava athlete ID and name, and for each activity its name, sport, time, distance, moving and elapsed time, elevation gain, average and maximum heart rate, calories, a summary of its route, and its main photo. The first time, we read the last 30 days, and Strava tells us when you add new activities.
- Sign-in providers. If you sign in with Apple (or another sign-in provider we offer), it tells us who you are as described above.
- Other users, who may mention or tag you, invite you, add you to a club or challenge, or report you.
- Business transaction partners. We may receive personal information in connection with an actual or prospective business transaction, for example from an entity we acquire or are acquired by, a successor, or an assignee, and/or in the context of an insolvency, bankruptcy, or receivership.
Automatic data collection
We and our service providers may automatically log information about you, your mobile device, and your interaction with the Service, such as:
- Device data, such as your device's platform, model, operating system and app version, its language and time zone, and, if you turn on notifications, a push notification token.
- Session and security data, such as when you signed in, and the IP address and user agent of each signed-in session, which we use to keep your account secure.
- Service log data, such as the requests your device makes to our servers, their timing and their outcome, which we use to operate, secure and debug the Service.
- Crash and diagnostic data, such as errors and crashes in the app, the steps and screens that led up to them, how long screens take to load, and, for some sessions, a recording of the app's screens with all text and images masked. These reports carry your account ID and IP address, and we use them to find and fix problems in the Service.
Location. If you allow it, the app reads your location once to show races near you first. It rounds it to about a kilometer before sending it, and we do not store it. The app does not track your location in the background. Workout routes come from Apple Health or Strava, not from the app, and we cut the first and last 250 meters off every route before we store it, so it never shows exactly where you started or stopped.
Microphone and speech. In cook mode, the app listens for spoken commands such as “next step.” Speech is recognized on your device where it supports that, and otherwise by your phone's speech service (Apple's on iPhone). We do not receive or store what you say.
Photos. The app only sees the photos you choose to add.
Data about others
You can tag friends in an activity, mention people, and invite people to join you. Please do not share someone's personal information with us, including in a photo, unless you have their permission.
Cookies, device storage and AI
Cookies. This website sets no cookies, and the Service uses no analytics, advertising or third-party tracking technologies. We do not track you across other companies' apps or websites, and the app does not ask to.
Device storage. The app keeps your sign-in session in your device's secure storage (the iOS Keychain or the Android Keystore), along with how far it has read from Apple Health.
Chat and other artificial intelligence (“AI”) technologies. When you share a link to Kaizen, such as a book, recipe or video, the Service uses AI models from third-party providers, which we reach through Vercel's AI Gateway, to work out what the link is and to turn a recipe page into a recipe. To do that, we send the link, the title your phone shared with it, and the text of the page to the model, and a browsing service may fetch the page on our behalf. We do not send your activities, health and fitness data, profile or messages to AI models, and we do not use your personal information to train AI models.
For information concerning your choices with respect to these technologies, see the Your choices section below.
How we use your personal information
We may use your personal information for the following purposes or as otherwise described at the time of collection:
Service delivery and operations
We may use your personal information to:
- provide the Service, including showing your activities and progress, counting your workouts toward your goals, importing from the apps you connect, building your feed, running challenges and leaderboards, and looking up the links you share;
- enable security features of the Service, such as sign-in codes;
- establish and maintain your user profile on the Service;
- facilitate social features, such as following, friends, clubs, meetups, challenges, invitations, comments and reactions, and show your content to the audience you choose;
- communicate with you about the Service, including by sending sign-in codes, in-app and push notifications you have not turned off, Service-related announcements, security alerts, and support and administrative messages; and
- provide support for the Service, and respond to your requests, questions and feedback.
Service personalization
We may use your personal information to:
- understand your interests, such as the niches you join and the goals you set;
- personalize your experience, such as suggesting people, clubs, programs and races; and
- remember your selections and preferences as you use the Service.
Service improvement and analytics
We may use your personal information to analyze your usage of the Service, improve the Service, help us understand how the Service is used, and develop new products and services. We do this with our own service logs and aggregated data; we do not use third-party analytics services.
Marketing and advertising
We do not show ads, we do not use your personal information for interest-based or targeted advertising, and we do not allow advertising partners to collect information through the Service. We never use information from Apple Health for advertising. We do not currently send marketing emails. If we start, we will give you a way to opt out of them.
Compliance and protection
We may use your personal information to:
- comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas, investigations or requests from government authorities;
- protect our, your or others' rights, privacy, safety or property (including by making and defending legal claims), including by reviewing reports and moderating content;
- audit our internal processes for compliance with legal and contractual requirements or our internal policies;
- enforce the terms and conditions that govern the Service; and
- prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, including cyberattacks and identity theft.
To create aggregated, de-identified and/or anonymized data
We may create aggregated, de-identified and/or anonymized data from your personal information and other individuals whose personal information we collect, such as how many people are working on a program or have read a book. We make personal information into de-identified and/or anonymized data by removing information that makes the data identifiable to you, and we will not attempt to reidentify any such data. We may use this data and share it with third parties for our lawful business purposes, including analyzing and improving the Service and promoting our business.
Further uses
In some cases, we may use your personal information for further uses, in which case we will ask for your consent if they are not compatible with the initial purpose for which the information was collected.
Who can see your information
Kaizen is a social service, so some of what you put in it is seen by other people.
- Always visible to everyone, including people who do not use Kaizen: your username, name and profile photo, and whether your account is private.
- Your profile details, such as your bio, website, the place you show, when you joined and your stats, are visible to everyone if your account is public, and only to the people you approve if it is private. We never show your time zone, language, units or currency to anyone else.
- Your posts and activities are visible to the audience you choose for each one: everyone, your followers, your friends, a group, or only you. New posts in the app default to your friends, and so do imported workouts. Posts you share with everyone can be seen by anyone, including people who do not use Kaizen, unless your account is private, in which case they are limited to your followers.
- Sensitive measurements, such as body weight, body fat, resting heart rate, heart rate variability, blood pressure, nutrition, fasting, mood and amounts of money, are never shown to anyone but you, and a post that includes them starts as visible only to you. Other workout details, such as distance, pace, calories and average heart rate, are shown to the audience of the post they are in.
- Other activity. Your comments and reactions are visible to the people who can see the post they are on. Your progress on a goal or program may be shown to friends working on the same one, your results to the other people in a challenge, and your membership and RSVPs to the other members of a club, group or meetup. If you invite someone, the invitation shows them your name, username and photo.
- Blocking. If someone is blocked, neither of you can see the other's profile details or posts.
How we share your personal information
We may share your personal information with the following parties (or as otherwise described in this Privacy Policy, in other applicable notices, or at the time of collection).
- Service providers. Third parties that provide services on our behalf or help us operate the Service or our business. These are:
- Amazon Web Services, for hosting our servers, databases and your photos, delivering our emails (Amazon SES), and logging and monitoring;
- Vercel, for hosting this website and for routing requests to AI models;
- the AI model providers that Vercel's AI Gateway reaches, and the browsing service that fetches pages, for looking up the links you share, as described above;
- Expo, and through it Apple and Google, for delivering push notifications, which receive your device's push token and the text of the notification;
- Sentry, for receiving the app's crash and diagnostic data described above; and
- Google Workspace, for the emails you send us.
- Other users and the public, as described in Who can see your information.
- Linked third-party services. When you connect Strava or Apple Health, or sign in with Apple, we exchange the information needed to make that connection work with that service. When you disconnect Strava, we revoke our access with Strava. When you share a link to a book, video or song, we send that link (and, for a book, its title, author or ISBN) to the service that can describe it, such as Open Library, YouTube, Vimeo, TikTok or Spotify. Their use of information is governed by their own privacy policies.
- Third parties designated by you. We may share your personal information with third parties where you have instructed us or provided your consent to do so.
- Professional advisors. Professional advisors, such as lawyers, auditors, bankers and insurers, in the course of the professional services that they render to us.
- Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.
- Business transferees. We may disclose personal information in the context of actual or prospective business transactions (e.g., investments in Kaizen Inc, financing of Kaizen Inc, public stock offerings, or the sale, transfer or merger of all or part of our business, assets or shares), including to prospective counterparties and their advisers, and to an acquirer, successor, or assignee of Kaizen Inc as part of any merger, acquisition, sale of assets, or similar transaction, and/or in the event of an insolvency, bankruptcy, or receivership.
We do not sell your personal information, and we do not share it with anyone for targeted advertising. We do not share information from Apple Health with third parties except the service providers above that help us run the Service, and only to provide it.
Retention
We generally retain personal information to fulfill the purposes for which we collected it, including for the purposes of satisfying any legal, accounting, or reporting requirements, establishing or defending legal claims, or for fraud prevention purposes. To determine the appropriate retention period, we may consider factors such as the amount, nature, and sensitivity of the personal information, the potential risk of harm from its unauthorized use or disclosure, the purposes for which we process it and whether we can achieve those purposes through other means, and the applicable legal requirements.
In practice, we keep your personal information for as long as your account exists. You can ask us to delete a post or other content, or your whole account, by emailing support@kaizen.inc from the address on your account. When we delete your account, we remove your profile and take you out of search, disconnect the apps you connected, and delete or de-identify the personal information associated with your account, except where we must keep some of it for the reasons above. Comments you left on other people's posts may remain, attributed to “Deleted user.” Our server logs are kept for 7 days, crash and diagnostic data for up to 90 days, and deleted information may persist in our database backups for up to 14 days until they are overwritten.
When we no longer require the personal information we have collected about you, we may either delete it, anonymize it, or isolate it from further processing.
Your choices
In this section, we describe the rights and choices available to all users. Users who are located in certain U.S. states can find additional information about their rights below.
- Access or update your information. You may review and update your profile and content by signing in to the app.
- Choose your audience. You choose who can see each post when you post it.
- Ask us. You can also email support@kaizen.inc from the address on your account to ask us to delete a post or other content, make your account private, keep you out of search and suggestions, limit who can send you friend requests, block someone, or delete your account.
- Connected apps. You can disconnect Strava or Apple Health in the app's settings, which stops us receiving new information from it, and choose whether to delete what it already imported. You can also limit what Kaizen reads from Apple Health in the Health app, and revoke Kaizen's access in your Strava settings.
- Device permissions. You can turn off Kaizen's access to your location, photos, microphone, speech recognition, Health data and notifications at any time in your device's settings. The features that need them will stop working.
- Communications. You will receive the emails the Service needs to work, such as sign-in codes. If we ever send marketing emails, you will be able to opt out by following the unsubscribe instructions in them or by contacting us.
- Reporting. You can report a person or a post to us at support@kaizen.inc.
- Do Not Track. Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. We do not track you across third-party websites or services, so we do not change our practices in response to these signals.
- Declining to provide information. We need to collect personal information to provide certain services. If you do not provide the information we identify as required or mandatory, we may not be able to provide those services.
Other sites and services
The Service may contain links to websites, mobile applications, and other online services operated by third parties, including the pages people share. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage you to read their privacy policies.
Security
We employ technical, organizational and physical safeguards designed to protect the personal information we collect. Information travels between your device and our servers encrypted with TLS, and our databases and photo storage are encrypted at rest. The tokens that let us read from apps you connect, such as Strava, are stored encrypted. However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information.
International data transfer
We are headquartered in the United States and store your personal information there. We may use service providers that operate in other countries. Your personal information may be transferred to the United States or other locations where privacy laws may not be as protective as those in your state, province, or country.
Children
The Service is not intended for anyone under 13 years of age. If you are a parent or guardian of a child from whom you believe we have collected personal information in a manner prohibited by law, please contact us. If we learn that we have collected personal information through the Service from a child under 13 without the consent of the child's parent or guardian as required by law, we will delete it and the child's account.
Changes to this Privacy Policy
We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service or other appropriate means. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of the Service after the effective date of any modified Privacy Policy indicates your acknowledging that the modified Privacy Policy applies to your interactions with the Service and our business.
How to contact us
If you have questions about our practices or if you would like to exercise any privacy related right that may be available to you, please email us at support@kaizen.inc.
Consumer health data
This section is our consumer health data privacy policy under the Washington My Health My Data Act and Nevada Senate Bill 370, and it applies to everyone who uses Kaizen. Some of the information in Kaizen reflects your physical health, and those laws call it “consumer health data.”
- What we collect. Workouts and their measurements (such as distance, duration, pace, calories and heart rate), workout routes, step counts, and the measurements you choose to log, such as body weight, body fat, resting heart rate, heart rate variability, blood pressure, sleep, nutrition, fasting and mood, as well as goals and programs that may reveal health information, such as training for a race.
- Where it comes from. From you, and from Apple Health and Strava if you connect them.
- Why we collect and use it. Only to provide the Service you ask for: to record your activities, count them toward your goals, programs and challenges, show your progress and records, and show your posts to the audience you choose.
- Who we share it with. The people you choose to share each post with, as described in Who can see your information; Amazon Web Services, which hosts it for us; and authorities where the law requires. We do not sell consumer health data, and we do not use it for advertising.
- Your rights. You can ask us to confirm whether we collect, share or sell your consumer health data, for access to it and a list of the third parties we have shared it with, to delete it, and to withdraw your consent to its collection and sharing. You can stop new health data reaching us at any time by disconnecting Apple Health or Strava, or by not logging it. To exercise any of these rights, email support@kaizen.inc. If we deny your request, you can appeal by replying to our decision, and if we deny your appeal, you can contact your state's Attorney General.
State privacy rights notice
Except as otherwise provided, this section applies to residents of U.S. states to the extent they have privacy laws applicable to us that grant their residents the rights described below (collectively the “State Privacy Laws”).
This section describes how we collect, use, and share Personal Information of residents of these states and the rights these users may have with respect to their Personal Information. Please note that not all rights listed below may be afforded to all users and that if you are not a resident of one of these states, you may not be able to exercise these rights. In addition, we may not be able to process your request if you do not provide us with sufficient detail to allow us to confirm your identity or understand and respond to it. We verify a request by confirming that it comes from the email address associated with your Kaizen account, for example by asking you to send it from that address or to answer a message we send to it.
For purposes of this section, the term “Personal Information” has the meaning given to “personal data”, “personal information” or other similar terms and “Sensitive Personal Information” has the meaning given to “sensitive personal information,” “sensitive data”, or other similar terms in the State Privacy Laws, except that in neither case does such term include information exempted from the scope of the State Privacy Laws.
Your privacy rights
The State Privacy Laws may provide residents with some or all of the rights listed below. However, these rights are not absolute and some State Privacy Laws do not provide these rights to their residents. Therefore, we may decline your request in certain cases as permitted by law.
- Information. You can request the following information about how we have collected and used your Personal Information:
- The categories of Personal Information that we have collected.
- The categories of sources from which we collected Personal Information.
- The business or commercial purpose for collecting and/or selling Personal Information.
- The categories of third parties with which we share Personal Information.
- The categories of Personal Information that we sold or disclosed for a business purpose.
- The categories of third parties to whom the Personal Information was sold or disclosed for a business purpose.
- Access. You can request a copy of the Personal Information that we have collected about you.
- Appeal. You can appeal our denial of any request validly submitted.
- Correction. You can ask us to correct inaccurate Personal Information that we have collected about you.
- Deletion. You can ask us to delete the Personal Information that we have collected from you.
- Opt-out.
- Opt-out of certain processing for targeted advertising purposes. We do not process your Personal Information for targeted advertising purposes.
- Opt-out of or appeal profiling/automated decision making. We do not use your Personal Information to engage in profiling or to perform automated decision-making that results in significant financial impacts, significant impacts on housing, education, employment, health care, or criminal justice, or similarly significant impacts. Suggesting people, clubs, programs and races, and counting workouts toward goals, are done for you, and never to make decisions about you.
- Opt-out of other sales of personal data. We do not sell your Personal Information within the meaning of State Privacy Laws.
- Consumers under 16. We do not sell or share the Personal Information of anyone, including consumers under 16 years of age.
- Sensitive Personal Information. Some State Privacy Laws treat health information, and precise location such as a workout route, as Sensitive Personal Information. We process it only to provide the Service you ask for, and with your consent where the law requires it, which you give by choosing to log it or to connect Apple Health or Strava. We do not process Sensitive Personal Information for the purpose of inferring characteristics about consumers under the CCPA.
Nondiscrimination. You are entitled to exercise the rights described above free from discrimination as prohibited by the State Privacy Laws.
Opting out of the “sale” or “sharing” of your Personal Information
We do not sell personal information, and we do not use services that deliver interest-based ads, so we do not “sell” or “share” your Personal Information as the State Privacy Laws define those terms. If we ever start, we will update this Privacy Policy first and give you a way to opt out. We nonetheless treat a Global Privacy Control (“GPC”) signal from your browser as a valid request to opt out of the sale or sharing of your Personal Information, and you may also send an opt-out request by email to support@kaizen.inc.
Exercising other state privacy rights
You may submit requests to exercise any of the other state privacy rights listed above via email to support@kaizen.inc.
Verification of identity; authorized agents
We may need to verify your identity in order to process your information, access, appeal, correction, or deletion requests and reserve the right to confirm your residency. To verify your identity, we may require government identification, a declaration under penalty of perjury, or other information, where permitted by law.
Under some State Privacy Laws, you may enable an authorized agent to make a request on your behalf. However, we may need to verify your authorized agent's identity and authority to act on your behalf. We may require a copy of a valid power of attorney given to your authorized agent pursuant to applicable law. If you have not provided your agent with such a power of attorney, we may ask you to take additional steps permitted by law to verify that your request is authorized, such as by providing your agent with written and signed permission to exercise your State Privacy Laws rights on your behalf, the information we request to verify your identity, and confirmation that you have given the authorized agent permission to submit the request.
Information practices
The following describes our practices currently and during the past 12 months:
- Sources and purposes. We collect all categories of personal information from the sources and use them for the business/commercial purposes described above in the Privacy Policy.
- Retention. The criteria for deciding how long to retain personal information is generally based on whether such period is sufficient to fulfill the purposes for which we collected it as described in this notice, including complying with our legal obligations.
